General Purpose
The general purpose of the Airport Land Use Plan is to promote the orderly development of the area surrounding airports in order to protect the general welfare of the public, enhance the safety of air navigation and traffic, and maintain the utility and economic viability of airport facilities. The authority and jurisdiction of the Airport Land Use Commission (ALUC) extends to the establishment of land use policies and can include the review of all new land uses on private or local government property within the airport planning area.

Authority and Requirements
The California Public Utilities Code (Article 3.5, Sections 21670-21679.5) requires that each county containing a public use airport must establish an Airport Land Use Commission.

The following powers and duties are assigned to the Commission:

1. To assist local agencies in ensuring compatible land uses in the vicinity of all new airports and in the vicinity of existing airports to the extent that the land in the vicinity of existing airports to the extent that the land in the vicinity of those airports is not already devoted to incompatible uses.

2. To coordinate planning at the state, regional and local levels so as to provide for the orderly development of air transportation, while at the same time protecting the public health, safety and welfare.

3. To prepare and adopt an airport land use plan pursuant to Section 21675.

4. To review the plans, regulations, and other actions of local agencies and airport operators pursuant to Section 21676.

5. The powers of the Airport Land Use Commission shall in no way be construed to give the Commission jurisdiction over the operation of any airport.

Pursuant to the provisions of the Public Utility Code, the Board of Supervisors established to the Mono County Airport Land Use Commission in January, 1986. The ALUC has adopted an Airport Land Use Plan for the Mammoth Lakes Airport area.

Limits To ALUC Jurisdiction
There are specific limits to ALUC jurisdiction. The Commission has no authority over airport operations, although the ALUC plan must include assumptions about future activities at each airport. Secondly, Commission jurisdiction and plan review are confined to land use impacts related primary to the area surrounding the airport. Thirdly, the jurisdiction of the Commission is limited to new land uses.

Existing uses which are found to be in conflict with existing or anticipated airport operations will not be subject to the land use review policies established by the Commission. However, if a change is sought to the existing land use that requires the consent of a public agency and is within the Airport Planning Area, such new use or modification of an existing use will require the review and consideration of the Airport Land Use Commission.

Consistency With Local General Plans And Airport Master Plans
State law requires local general plans and applicable specific plans to be consistent with the ALUC plan. In the event that the ALUC plan is amended, the law requires the County/Town to amend its general or specific plan within 180 days to be consistent with the revised ALUC plan. In the event that the County/Town does not concur with the provision of the ALUC plan, the County/Town may override the ALUC by two-thirds vote after making specific findings that the proposed action is consistent with the purposes of Section 21670 of the PUC.

State law provides that, before modification of an airport master plan, the public agency owning the airport must submit the proposed change to the ALUC for a finding of consistency with the ALUC plan. Such an action was taken by the ALUC regarding the Update of the Mammoth/June Lake Airport Master Plan in May of 1989.
